Special Prosecutor In Jussie Smollett Probe Blasts Prosecutor Kim Foxx For Mishandling Case

Dan Webb, the special prosecutor who has been looking into the state attorney’s handling of the Jussie Smollett case in Chicago, stated that the office of Kim Foxx abused its discretion in their case against the actor.

Fox News reported that special prosecutor Dan Webb slammed Foxx and her assistant prosecutors, saying that their handling of the case was marked by disarray and misleading statements. However, he made sure to add that they did not do anything criminal. 

Special Prosecutor Blasts Kim Foxx

Foxx shocked the nation in March of 2019 when she inexplicably dropped all charges against Smollett, who had been accused of staging a hate crime against himself.

Smollett, who was best known for starring on the television show “Empire,” had claimed that he was jumped by two men in January of 2019, alleging that they hurled racist and homophobic slurs at him while also shouting “this is MAGA country.”

Police, however, concluded that Smollett had staged this hate crime against himself, and paid the two men to attack him.

Webb Doubles Down On Prosecutors

Webb restored the charges against Smollett back in February, saying at the time that they never should have been dropped in the first place.

He found that the state’s attorney’s office’s “decision-makers” who worked the initial Smollett case “did not learn of any new evidence between when the [Cook County State’s Attorney’s Office] filed a 16-count indictment against Mr. Smollett on March 7, 2019, when the CCSAO believed it had a strong case against Mr. Smollett, and March 26, 2019, when the entire indictment was dismissed.”

Webb added that both “decision-makers,” Acting State’s Attorney Joseph Magats and Lead Prosecutor Risa Lanier, had “significantly and meaningfully divergent explanations” for how the decision was made.

Also at issue was the lack of accountability. “The only punishment for Mr. Smollett was to perform 15 hours of community service that had no relationship to the charged conduct,” Webb went on to add in this report.

He explained that the office “only” required “Mr. Smollett to forfeit his $10,000 bond as restitution to the City of Chicago (a figure amounting to less than 10% of the $130,106.15 in police overtime pay that the City alleges it paid solely due to Mr. Smollett’s false statements to police.”

Foxx And Prosecutors Told Blatant Falsehoods

When talking to the press about dropping the charges, Foxx and her prosecutors told outright falsehoods, including about the amount which Smollett was required to pay, according to the report.

The office, and Foxx herself, “made false public statements representing that $10,000 was the most Mr. Smollett could have been ordered to pay in restitution under the law when there is no such cap under the provision of the disorderly conduct statute under which Mr. Smollett was charged.”

If you ask me, when Jussie Smollett allegedly staged his hate crime, he tried to play off the racial and political divides our country is facing right now for his own personal gain.

For that reason, millions of Americans would love to see him finally be brought to justice.
