Singer Miley Cyrus has been hit with a lawsuit over her hit song “Flowers.” She’s being accused of copying the song from the Bruno Mars hit “When I Was Your Man.”

Cyrus Hit With Lawsuit

People Magazine has obtained a copy of the lawsuit, which was filed in a Los Angeles court on Monday. Tempo Music Investments, which owns a share of the copyright in Mars’ song after it acquired songwriter Philip Lawrence’s music catalog, is claiming that many fans “recognized the striking similarities” between the two songs after “Flowers” came out.

“It is undeniable based on the combination and number of similarities between the two recordings that ‘Flowers’ would not exist without ‘When I Was Your Man,'” the lawsuit alleges.

“Any fan of Bruno Mars’ ‘When I Was Your Man’ knows that Miley Cyrus’ ‘Flowers’ did not achieve all of that success on its own,” the lawsuit continues. “‘Flowers’ duplicates numerous melodic, harmonic, and lyrical elements of ‘When I Was Your Man.’”

“Accordingly, Plaintiff brings this action for copyright infringement arising out of Defendants’ unauthorized reproduction, distribution and exploitation of ‘When I Was Your Man,'” reads the lawsuit.

Cyrus And Her Fellow Defendants

Tempo Music Investments lists Cyrus, 31, along with multiple other defendants, including the “Flowers” songwriters Gregory Hein and Michael Pollack. Additional defendants are Sony Music Publishing and Apple.

It should be noted that Mars himself is not named as a plaintiff in the filing.

One of the accusations in the lawsuit is that “the opening vocal line from the chorus of ‘Flowers’ begins and ends on the same chords as the opening vocal line in the verse of ‘When I Was Your Man.'”

Tempo Music Investments has stated that the goal of this lawsuit is for Cyrus and her fellow defendants to stop reproducing, distributing or publicly performing “Flowers.” While the company wants damages, the specific amount is yet to be determined. 

At the time of this writing, Cyrus has yet to respond to this lawsuit. Mars also has not spoken out to address it.

One Year Anniversary Of ‘Flowers’

Back in January, Cyrus took to Instagram to celebrate the one year anniversary of the release of “Flowers.”

“One year ago today ‘Flowers’ started making people happy & that makes me happy. Love you. Thank you,” she wrote. “XO MC.”

“Flowers” spent eight weeks at the top of the U.S. Billboard charts. It also went to the top of the Spotify charts. In fact, it became the most-streamed song in a single week in Spotify history. In addition, “Flowers” was nominated for Song of the Year at the Grammys.

Fans have long believed that “Flowers” is about Cyrus’ ex-husband Liam Hemsworth, whom she was married to from 2018 to 2019.

“I never need to be a master at the craft of tricking an audience,” Cyrus said when she was asked about this speculation. “It will set itself on fire all by itself.”

Meanwhile, Mars’ “When I Was Your Man” also made it to the top of the Billboard Hot 100 chart in April of 2013.

It will certainly be interesting to see how this lawsuit turns out!
