Tiger Woods is being sued by his ex-girlfriend Erica Herman, who he dated for six years, with her claiming that she was “forced to sign” an NDA.

In court documents obtained by TMZ, Herman is claiming that the NDA is being wrongfully enforced on her, citing the Speak Out Act, which states that the “NDA is not enforceable if agreed to before a dispute involving sexual assault or sexual harassment,” according to Daily Mail

Herman, 38, is alleging that a private trust run by Woods, 47, is pressuring her to stick to the NDA and keep quiet. She also claims that she was forced to sign the NDA right after she began dating Woods in August of 2017. 

“This uncertainty is acute and important,” Herman’s complaint reads, according to ESPN. “Because of the aggressive use of the Woods NDA against her by the Defendant and the trust under his control, the Plaintiff is unsure whether she may disclose, among other things, facts giving rise to various legal claims she believes she has.”

“She is also currently unsure what other information about her own life she may discuss or with whom,” the complaint adds. “There is therefore an active dispute between the Plaintiff and the Defendant for which the Plaintiff needs a clarifying declaration from the Court.”

Herman’s Lawyer’s Request To Judge

If the judge decides to uphold the NDA, Herman’s lawyer has asked asked the judge to specify how it limits her ability to disclose things like “her own experiences,” “experiences of her family members,” “photographs and recordings of herself and her family members,” “information from sources other than the Defendant” and “information responding to statements that the Defendant has made or published about her or others to prove the falsity or misleading nature of those statements.”

Herman reportedly wants to share her experiences that she had with Woods, although it is unclear at this time if she is making any specific accusations against him. The couple had not been seen together publicly since the U.S. Open in August of last year.

Herman And Woods’ History

Herman was working as a general manager at the Presidents Cup, a pop-up restaurant at the Genesis Open at The Riviera Country Club in Los Angeles, California, which was owned by her then-boyfriend when she met Woods back in 2017. She and Woods became inseparable immediately, and she was often spotted at his golf tournaments cheering him on in the subsequent years. Prior to their breakup. they were living together in Jupiter, Florida.

“No one has signed any paperwork,” a friend of Woods told People Magazine back in 2018. “It’s not like they’re pledging their lives to each other. But she’s really nice and Tiger likes her.”

“Tiger doesn’t like to be alone,” the friend added. “But he doesn’t like to settle. Not anymore. So when he’s with someone, he really needs to be into her.”

Woods was previously married to Elen Nordegren from 2004 until 2010, when they divorced after he admitted to having multiple affairs. Woods has yet to speak out about his latest breakup, and he has also not publicly responded to Herman’s legal filing.

It remains to be seen how this will all play out for the legendary golfer.
