Former “Empire” actor Jussie Smollett snapped at the prosecutor on Tuesday as he took the stand at his own trial in testimony that legal experts are saying will likely backfire on him.

Smollett Snaps At Prosecutor 

Insider reported that Smollett snapped at special prosecutor Dan Webb when he questioned Smollett about Instagram exchanges that he had with Abimbola Osundairo, one of the two Nigerian brothers the actor allegedly hired to attack him in 2019. 

“Mr. Webb, with all due respect you do not understand Instagram,” Smollett said at one point. Webb immediately fired back by saying, “Look at me. I’m older. I tell you right now I do not understand Instagram … I’m asking you if the messages I’m about to show you are between Bola [Abimbola] and you.”

Webb claimed that in the hours before the attack, Smollett sent information about his flight delay to Osundairo, saying that this was evidence that they were coordinating. However, Smollett alleged that he was updating his millions of followers about his flight delay on his Instagram Story.

“You’re misrepresenting me to the jury and to the entire court, and it’s not fair,” Smollett told Webb. “Without showing the actual Insta stories that I posted, they’re not getting the full story, so they don’t understand.”

When Webb asked if he told police that his attackers were white because it would have made his hate crime claim more credible, Smollett responded, “You would have to ask someone who actually planned a fake hate crime.”

Legal Experts Weigh In

Legal experts have since said that Smollett’s testimony did not go well for him.

“Smollett testifying in his own defense is one of two things, or maybe both: a narcissistic criminal defendant who is doubling down on his charged lies to law enforcement or defense attorneys who know they are way behind and are throwing a low probability Hail Mary to try to get their client off,” former U.S. attorney Neama Rahmani told Fox News.

“Either way, Smollett’s story was a bizarre attempt at forcing a square peg into a round hole by offering every possible explanation for the state’s digital evidence except the most obvious one: that he is guilty,” she added. “In the unlikely event he is acquitted, Smollett’s decision was a genius move. But it is far more likely that the jury sees through his ruse and Smollett is convicted. If so, the judge may sentence him to prison time for obstructing justice and perjuring himself on the witness stand.”

Smollett’s Testimony ‘Unparalleled Disaster’

Michigan attorney James White described Smollett’s testimony as an “unparalleled disaster,” saying that he not only “hurt his case” but also “went beyond and made the prosecutor’s case” in the process.

“His story is so unbelievable and in the face of the evidence that no reasonable jury is ever going to buy it,” White said. “I think that he absolutely buried himself to the extent he wasn’t already buried.”

Smollett has been accused of paying the brothers to attack him while shouting racist and homophobic slurs at him and also screaming “this is MAGA country” in the hopes of garnering a larger salary for himself on “Empire.” If convicted of faking a hate crime against himself, Smollett is facing up to three years in prison.
