Disgraced “Empire” star Jussie Smollett got some bad news on Wednesday when a federal judge dismissed his malicious prosecution lawsuit against the city of Chicago and several police officers.
Federal Judge Throws Out Jussie Smollett’s Lawsuit Against Chicago
Fox News  reported that Smollett, 37, filed the counter lawsuit back in November after he was hit with a $130,000 suit by the city of Chicago.
The city was suing Smollett for reimbursement for the overtime officers put in when investigating the alleged racist and homophobic attack against him in January of 2019.
Chicago police’s investigation concluded that Smollett had staged the attack. Officers speculated that he did so to secure a raise for himself on his hit Fox show “Empire”. The investigation’s finding that Smollett’s report was a hoax pointed to an grievous waste of city resources.
Smollett’s November counter lawsuit claimed that he was a victim of malicious prosecution that left him with humiliation and distress.
But U.S. District Judge Virginia Kendall was not having any of it.
Yesterday, the federal judge ruled that he could not file a malicious prosecution claim until all proceedings against him, including his February indictment on six counts of lying to police, have ended.
Judge Kendall also said in her ruling that the Chicago Police Department was motivated to bring Smollett to justice “for a crime it had probable cause to think he committed.”
Jussie Smollett Stands By His Story
To this day, Jussie Smollett stands by his January 2019 police report.
The actor claimed that he was jumped by two men who shouted racist and homophobic slurs at him while also saying “this is MAGA country.”
Smollett was facing decades in prison for his allegedly false police report until Chicago prosecutor Kim Foxx inexplicably dropped all charges.
The dropped charges were a shock to the city of Chicago. And also to Americans everywhere who wanted to see him brought to justice.
Thankfully, special prosecutor Dan Webb was brought in to review the case and Foxx’s decision to drop the charges. Webb’s review of the case is how the February charges ended up being filed against him.
Jussie Smollett’s Attorney Issues Statement On New Charges
The out-of-work actor has stuck to his original story. Smollett’s attorney issued the following statement  when the latest charges were filed:
“This indictment raises serious questions about the integrity of the investigation that led to the renewed charges against Mr. Smollett, not the least of which is the use of the same CPD detectives who were part of the original investigation into the attack on Mr. Smollett to conduct the current investigation, despite Mr. Smollett’s pending civil claims against the City of Chicago and CPD officers for malicious prosecution. And one of the two witnesses who testified before the grand jury is the very same detective Mr. Smollett is currently suing for his role in the initial prosecution of him.”
“After more than five months of investigation, the Office of the Special Prosecutor has not found any evidence of wrongdoing whatsoever related to the dismissal of the charges against Mr. Smollett. Rather, the charges were appropriately dismissed the first time because they were not supported by the evidence. The attempt to re-prosecute Mr. Smollett one year later on the eve of the Cook County State’s Attorney election is clearly all about politics not justice.”
The Road To Justice
Smollett can stand by his story all he wants, but nobody is buying it at this point.
We applaud Judge Kendall for tossing out his ridiculous counter lawsuit against Chicago.
Justice is way overdue in this case, and we can’t wait to see Jussie Smollett finally face judgement.
His purported hoax that played off the racial and political divides that currently plague our nation for personal gain.
