Judge Obliterates Chicago Prosecutors For Letting Jussie Smollett Off The Hook

Weeks after Chicago prosecutors controversially decided to drop all charges against “Empire” star Jussie Smollett, their move has come back to bite them as a Cook County judge completely obliterated them over it.

Fox News reported that Cook County Judge Marc Martin slammed State Attorney Kim Foxx and her office for dropping charges against Smollett for staging a hate crime against himself as the judge presided over an unrelated case. Martin explained that Foxx and her team had created a situation in which anyone charged with filing a false report could expect the same leniency her office gave to Smollett.

Martin was hearing the case of 21-year-old Candace Clark, who has been charged with one felony count of filing a false report. Prosecutors say that she gave a friend access to her bank account before calling police and telling them money had been stolen, but Clark denies the charges and claims she’s a victim of a double standard from Foxx stemming from the prosecutor’s decision to let Smollett off the hook.

“Well, Ms. Clark is not a movie star, she doesn’t have a high-price lawyer, although, her lawyer’s very good. And this smells, big time,” Martin told prosecutors in court. “I didn’t create this mess, your office created this mess. And your explanation is unsatisfactory to this court. She’s being treated differently.”

“There’s no publicity on this case,” he continued. “She doesn’t have Mark Geragos as her lawyer or Ron Safer or Judge Brown. It’s not right. And (if) I proceed in this matter, you’re just digging yourselves further in a hole. (If the) press gets a hold of this, it’ll be in a newspaper. Why is Ms. Clark being treated differently than Mr. Smollett?”

This comes after it was confirmed that even though Foxx recused herself from the Smollett case, she continued to interfere in it and pressured prosecutors to drop charges against him.

“Sooo……I’m recused, but when people accuse us of overcharging cases…16 counts on a class 4 becomes exhibit A,” Foxx wrote in a text message to the head prosecutor on the case back in March. “Pedophile with 4 victims 10 counts. Washed up celeb who lied to cops, 16. On a case eligible for deferred prosecution I think it’s indicative of something we should be looking at generally. Just because we can charge something doesn’t mean we should.”

Millions of Americans are still furious that Smollett will not face justice for claiming to be a victim of a hate crime that he pinned on supporters of Donald Trump, so it’s nice to see a judge slam Foxx for how she handled this situation. Foxx has shown the public that she has no business being a prosecutor for the city of Chicago, so we can only hope that this chastisement from a federal judge leads to her making the decision to resign.
